Lawsuit Protection Strategies

In today's volatile medical professional liability climate, it’s important for physicians to consider strategies to protect their assets. 

A few of the reasons why this is important include: 

  • "Lottery" verdicts -- Juries sometimes render decisions based on sympathy and confusion rather than medically sound assessments. While Act 13 of 2002 could help reduce the exponential growth of jury verdicts, physicians should not grow complacent.
  •  Potential loss of de facto cap – Pennsylvania’s mandatory coverage requirements frequently are characterized as a de facto cap on medical professional liability awards.  However, there is concern that plaintiffs will pursue individual physician assets in the future.
  •  Insurance carrier insolvencies – A few years ago, professional liability insurer insolvencies were big news. While they have decreased, alternative forms of liability insurance, such as Risk Retention Groups (RRGs), pose their own set of risks.
